The traditional “realist” conception of physics, according to which human concepts, laws and theories can grasp the essence of a reality in our absence , seems incompatible with quantum formalism and it most fruitful interpretation. The proof rests on the violation by quantum mechanical formalism of some fundamental principles of the classical ontology. We discuss if the conception behind Einstein’s idea of a reality in our absence, could be still maintained and at which price. We conclude that quantum mechanical (...) formalism is not formulated on those terms, leaving for a separated paper the discussion about the terms in which it could be formulated and the onto-epistemological implications it might have. This paper examines the impact that recent advances in clinical neurology, introspectionist psychology and neuroscience have upon the philosophical psycho?neural Identity Theory. Topics covered include (i) the nature and properties of phenomenal consciousness based on a study of the ?basic? visual field, i.e. that obtained in the complete dark, the Ganzfeld, and during recovery from occipital lobe injuries; (ii) the nature of the ?body?image? of neurology and its relation to the physical body; (iii) Descartes? error in choosing extension in space (...) as the criterion for distinguishing the physical and the mental; (iv) the technical distinction between sensing and perceiving; (v) why phenomenal Direct Realism is incorrect whereas epistemic DR and the representative theory are correct; (vi) the ontological and topological status of phenomenal space and physical space. This leads to considerations of the current ?binding problems? in neuroscience; the role of the brain mechanisms that construct the sensory fields of phenomenal consciousness; the ?homunculus? fallacy; the key difference between epistemic and non?epistemic perception as revealed by brain injury studies; and how the brain codes information, contrasting topological and vectorial coding, with particular reference to the binding problem. My conclusion is that the Identity Theory is incompatible with the scientific evidence from an integrated approach to modern introspectionist psychology, clinical neurology, and neuroscience. However, Cartesian Dualism is even more incompatible with the evidence. This leaves only two viable theories. The first is Bohr's theory of brain?consciousness complementarity. The second is the Broad?Price?Smythies theory of extension, which is a topological theory of the relation between phenomenal space and physical space. (shrink)

The accurate pricing of securities in the capital markets depends upon the markets being both efficient and fair. In management buyout transactions (MBOs), the price bid by inside managers enhances the efficient pricing of securities but raises a reasonable doubt about the fairness to existing shareholders. This study addresses this fairness question in MBOs and offers short-term and long-term legal alternatives which allow both the efficiency and fairness criteria to be met. In the short-term the case law established in (...) the Basic v. Levinson decision for merger negotiation disclosures should be applied to MBO transactions. Over the longer horizon, legislative changes should be made to existing securities laws. Applying the investor protection principles of the 1933 and 1934 securities acts to MBO transactions will suppress the temptation of managers to extract shareholder wealth for their personal gain. While the decision of the House of Lords in Re F in [1990] clarified somewhat the law concerning the treatment of the mentally incapacitated adult, many uncertainties remained. This paper explores proposals discussed in a recent government green paper for reform of the law in an area involving many difficult ethical dilemmas.

This paper investigates the behavior of conformal fluctuations of space-time geometry that are admissible under the quantized version of Einstein's general relativity. The approach to quantum gravity is via path integrals. It is shown that considerable simplification results when only the conformal degrees of freedom are considered under this scheme, so much so that it is possible to write down a formal kernel in the most general case where the space-time contains arbitrary distributions of particles with no other interaction except (...) gravity. The behavior of this kernel near the classical space-time singularity then shows that quantum fluctuations inevitably diverge near the singularity. It is shown further that the root cause of this divergence lies in the fact that the Green's function for the conformally invariant scalar wave equation diverges at the singularity. The limitations on the validity of classical general relativity near the space-time singularity are discussed and it is argued that the notion of singularity itself needs to be radically modified once the quantum effects are taken into account. The current rise in malpractice litigation has led to concern in the research community as to the prospect of litigation against researchers. Clearly as the responsibility for the day-to-day conduct of the research falls upon the researchers they will be potentially liable should there be negligence in the conduct of the research project itself. But to what extent can the research ethics committee and its members be held liable should harm result to the research subject? How far does the prospect (...) of the threat of litigation equate with the reality of the prospect of liability? Although the NHS research governance framework suggests that primary responsibility for the conduct of the trial is with the researcher this does not mean that REC members will be immune from actions in tort where research subjects suffer harm in the conduct of a research project approved by their NHS REC. This paper focuses upon the prospect for liability in the law of tort of NHS RECs and their members. While in practice the vast majority of such claims are unlikely to be successful members of RECs may incur resultant legal costs as a consequence of involvement in proposed litigation. It is submitted that the scope of indemnity provision provided to RECs and their members should be precisely determined, otherwise there is a real prospect that the risk of malpractice litigation may deter individuals from serving on such committees. The Human Tissue Act 2004 presents a radical change to the legal regulation of the use of human material in England and Wales. The Act presents a broad regulatory framework but much in the practical operation of the legislation will depend upon regulations to be enacted and a new Code of Practice. This article examines 'appropriate consent' for the use of human tissue for research purposes in the context of the living competent adult. It examines the provision of information as (...) part of the consent process for the use of human materials for research purposes, the question of when consent can be withdrawn, and the controversial exception enabling the use without consent of anonymized material for research purposes where the research has been ethically approved. The paper concludes by highlighting some of the problems which may remain after the legislation comes into force. (shrink)
